And now California, which many call a trendsetter for the nation, is seriously contemplating nullification of federal laws and even secession from the Union. Official action of this type was only completed once in American history, beginning with the South Carolina severance of ties in September 1860 with the twelve other eventual Confederate States doing the same in rapid succession, leading up to the tragic Civil War. After four bloody years, the Union was saved by victory and has remained fast since.
Can California accomplish this and will the United States allow it? Also, how many citizens of the United States in California seek this action, since any vote by the people could very well be subject to challenge due to the rules for voting.
In answering the first we might look back to the writings of James Monroe, a firm believer in a federal system of government with different powers afforded to the two levels of governance. The Constitution makes it clear that laws governing immigration of aliens to this country is under the direct control and purview of the federal government and this includes the removal of illegal persons, with the highest priority being those who are criminals. Yet California, which has a large number of sanctuary cities is now contemplating designating the state a sanctuary state, refusing to comply with federal processes for removal of those who should not be there.
This is foolish behavior, and it personified best by Nancy Pelosi from her minority leader's perch in Washington. Earlier this week she stated that there are no alien criminals in California cities like San Francisco, yet the fallacy of her statement is clear for the world to see. Just remember poor Kate Steinle, a beautiful young woman strolling down Fisherman's Wharf when a five time deported illegal murdered her in cold blood on that pier while her father witnessed the attack first hand. And there are many others reported and had it not been for President Trump there would probably be little if any notice by the mainstream press. Laws under the correct purview of the federal government which apply to the entire nation are valid throughout the nation, so if California and it's Governor decide to do otherwise, they could face serious penalties including jail time. Nullification by California would constitute a major lawbreaking.
But then again, even the University of California Berkeley, with riots taking place this week and significant physical damage done by anarchists protesting a conservative speaker on campus, told law enforcement to stand down. And in case you wonder why, their Chancellor is non other than Janet Napolitano, who led the Department of Homeland Security into creating the mess we have in the first place.
And then there is the bigger question of secession by California from the United States. While a state might be able to get away for a time with a secession movement, the state does not have the right to cancel citizenship of her citizens since citizenship is a national and not a state function. So if citizens of California wish to remain American citizens, California must recognize the same by law. This argument which was made by Madison many years before the Civil War was one of the key arguments supporting the Union's use of force to end the Confederacy. So does California want to emulate South Carolina or the Confederacy even though a likely majority of her citizens want to retain their citizenship? An interesting question to consider.
And one last point. A few years ago, Arizona made serious attempts to carry out federal law regarding illegal immigration since the Obama Administration refused to enforce the very law they swore to uphold. When the Arizona effort therefore failed, why would anyone think that California can do something much more drastic, officially attempting to void that law, when it has no authority to do so?
These are troubling times, my friends, and it's time for America to face the music with truth and honesty, not from under the veil of political correctness. Otherwise this land will ultimately perish and the replacement will be - well - not something that most of us would want to see. Succumbing to lawlessness and tyranny never ends well.
