
Over a significant period of time, the problems that our system has internally caused have grown to a tipping point which threatens our very existence as a democratic republic. These issues include our national debt crisis, over regulation and its cost in terms of productivity and lowering of the GDP, attacks on state sovereignty by a power hungry Congress and the resultant federal takeover of decision making which should have been left with the states.
But luckily for us, the wise Founders left a tool for us to use to change things when they get too out of line and, no, I'm not talking about revolution. It's found in Article 5 of the Constitution and it allows states to convene a constitutional convention if thirty four state legislatures vote to request it.
Congress can't turn them down, they can only designate the where and when of the gathering and they have no authority to override it. And if the convention proposes changes, the proposal is submitted back to the states for ratification. If thirty eight states ratify it, the changes are enacted. The process is designed to deal with one problem area not the entire constitution, but it is recommended that the subject be broad enough to where it will have impact on all problems to be solved. And example would be to return power to the states that have been usurped over time, such as the application of the Commerce Clause as it has been used for expansion. Certainly, qualified constitutional legal experts would be needed to be sure that it would stand, but the Congress would not be able to override it.
There is an organized group that is working on this and you can go to a web site which has good information on the process, ConventionofStates.com, which explains how it would work and the safeguards that it provides. Many are skeptical but look at things this way: do we ever think that the Congress or even the court system will respond to the will of the people? I think we have seen in recent events that they are all working together against us with the Presidency, which over history has always tried to exert more and more influence and power over the other two branches.
